Enrolling with Arkansas State University from South Africa via Uni4 has a few legal aspects and terms & conditions, especially pertaining to cancellations that you need to be aware of. The purpose is transparency in informing your decision and knowledge of the contractual agreement that you are entering.

Few things hurt more than money. Therefore it is imperative to have an adequate and upfront description of your agreement and how a cancellation is legally viewed and how a possible refund would be considered and processed.

It is imperative that you familiarise yourself with the contents of this page. It describes the bond between parties within the context of a financial agreement for the delivery of services.

The parties, to be known, as Uni4 "Recruiter" and Arkansas State University "University" are respectively a South African and United States of America registered institution and form jointly a bond to deliver education in South Africa.

Legal

The Recruiter and the University are delivering a marketing, sales, and pedagogical service to enrolled students in South Africa for University programmes delivered online. These are facilitated by the academic staff of the University

Recruitment is comprised of marketing, sales, and payment. The University performs registration and the delivery of pedagogical services, i.e. teaching and academic support. The Recruiter fulfils a rudimentary post-registration service that ensures the student's administration with their financial accounts and the registration and academic support by the University are on an acceptable standard. The Recruiter liaises with the Student on administrational matters and facilitates and officiates consultation with the University.

Contract

Uni4 ("Recruiter") has partnered with the Arkansas State University ("University") to provide non-accredited learning programmes online to South African citizens ("Students").

The Recruiter is not an employee, affiliate, or spokesperson of the University. Students who enrol for any of the available courses are not entitled to go the the United States of America to participate in these certified courses.

Any marketing performed by the Recruiter have been diligently approved by the University to ensure a true reflection of the product, its intention, and compliance with reciprocal country laws.

Courses from the University are certificated courses that are non-credit bearing but verifiable by the University. Students are non-United States citizens, i.e. South Africans, recruited by the Recruiter and registered by the University for a certificate course offered on this site.

Tuition fees, listed for course pathways on this site, are all inclusive of all services to deliver the full pathway to the student. A pathway is a compilation of related subject matter modules that resemble a pedagogical whole.

The Student agree to a relationship with the Recruiter and the University. The Recruiter is responsible for the marketing, sales, payment, and administrational liaison with the University on behalf of the Student. The University delivers pedagogy and academic support to the Student.

Students are assessed by the Recruiter to determine financial adequacy as well as consulting and informing about courses so that a clear and acceptable position can be reached to facilitate a beneficial registration. A student may not be proposed (for enrolment) who does not satisfactorily meet all admission requirements of the University. The Recruiter cannot make any guarantees to a prospective Student that they will be admitted to the University. The right is expressly reserved by the University and their decision turnaround time is fourteen (14) days.

Classes are cohort based and require a minimum student enrolment count of ten (10) students prior to commencement. The commencement is subject to the cohort.

Payment is a two-step process. A 20% deposit books a seat. A seat is dependent on a cohort of ten (10) students. The deposit is payable on Invoice, i.e. once a course is purchased from UNi4 either through a Student Advisor or directly from the online shophttps://bit.ly/2OfQGL6. The deposit is forfeited if the customer reneges on the purchase if the cohort is reached. If the cohort is not reached prior or on the indicated commencement date (as per the online ticker) the deposit is refundable. Full course payment is made on University acceptance, prior to Registration.

The Recruiter shares the personal details of the Student with the University for academic and administration purposes. This information may also be used to acquiesce regulatory agencies, be these government or other accreditation bodies.

The Recruiter and the University will not engage in unethical practices, using the personal information of students. The University has published an Appropriate Use for reference.

The Student acknowledges and binds themselves to the Terms & Conditions and the Cancellations and Refunds requirements as well as to theUniversity Policies and Procedures.

Terms & Conditions

The student, by agreeing to this, agrees Contractually on the Terms and Conditions and the Cancellation and Refunds policies, as well as the University Policies and Procedures. The Student binds themselves with the conditions and roles of the respective parties, viz. the Recruiter, the University, and the Student.
Payment by a third party binds the third party to the same.

These courses are non-credit bearing 30 week short-learning courses that are aimed at building skills and knowledge 100% online.

Students attend online classes that are facilitated by professors and subject matter experts at the University. The University is the certificate issuer. With successful completion of the online course, the student is awarded with an industry and internationally recognised qualification. These courses are non-accredited short-courses aimed as delivering skills and self-improvement.

Registration of a Student is performed by the University, while the recruitment, obtaining of information, and payment is performed by the Recruiter.

To participate and successfully complete the short learning programmes, a Student requires a registered email account, access to a computer/ laptop/ tablet and stable internet connection. This computing device needs to be at least equivalent to an Intel i5 processor and have about 8Gb of ram. The internet connection should be at least 4Mbps with 80Gb of available data.

All information (including personal information) provided to the Recruiter on registration, on creating an account, or while accessing University services and online courses, must be true, accurate and complete. Students are responsible for updating the Recruiter in the event of a change to information.

Under the age of 18 written consent and assistance from a parent or legal guardian to enter these Terms and Conditions is required. Any such registration is separately managed to ensure compliance with all applicable legal requirements.

On registration course fees are payable in South African Rand (ZAR) to the Recruiter. Neither the Recruiter nor the University offer any payment terms, the full course fee is payable. The Course is paid for not the separate or elected modules.

Courses are comprised of a pathway of modules. Each module requires time to complete that is comprised of twice weekly night classes online and extra time during the week for self-study.

English is the language of instruction and administration for all learning programmes. All coursework that is required for assessment purposes must be written in English. This includes posts made on the discussion forums.

Only registered students, for an online learning programme, may participate in that programme. A student may not provide a username or password to any other person. They may not permit any other person to participate in the programme on their behalf and may not impersonate any other person.

The University conducts classes and assessments of Students and is responsible to the Academic grading and feedback to the Student.

Cancellations

Cancellation of a programme is subservient to the Consumer Protection Act (CPA) of South Africa and the extended (but conformant) stipulations of this policy.

A deposit (made to purchase a course) is refundable if the cohort is not reached as advertised. If the cohort is reached and the customer reneges, the deposit is forfeited, i.e. is not refundable.

A registered course cancellation must be made known in writing or any other recorded manner and form, within five (5) business days after the later date on which the agreement was concluded. A Student can use the Web Site’s (go.arkansasuniverity.online) Live Chat function. A cancellation for results from the notification and serves to inform all parties in the conclusion of the cancellation and refund action.

A refund, even within the cooling off period, is not a 100% refund as this registration is made to an international institution and that results in elevated costs in transferring the money and accommodating the exchange rate as well as the administrational costs of the parties.

After the cooling-off period, a Student is not entitled to a refund of the course fees. Any refund arrangement, in this any case, is at the discretion of the University. If any such decision is taken, it concludes in ninety (90) business days of the decision.

The University reserves the right to suspend access to environments and/ or course materials in the event of a payment dispute. Any resulting discussion is conducted according to the guidance of the South African Labour Relations Act (LRA) Par. 69.

The University reserves the right to suspend access to course material in the event of payment infraction.

The Recruiter will act as a mediator between the University and the Student for the purpose of determining the facts and resolving the dispute. All in observance of the LRA stipulations.
